The Justice Department says agents can’t access 2.5 miles of the border and a boat ramp in Eagle Pass.

The Texas National Guard and state troopers have blocked U.S. Border Patrol agents from a 2.5-mile stretch of the Rio Grande in Eagle Pass, preventing federal agents from patrolling that part of the border, according to a court filing by the U.S. Department of Justice, escalating the clash between state and federal authorities on the Texas-Mexico border.

On Wednesday night, troopers and National Guard members began to take “full control” of the 47-acre Shelby Park, erected concertina wire and fencing at the park to close off access to the public, Eagle Pass Mayor Rolando Salinas said. He added that he was told that the park would be closed indefinitely and the state took the action to prevent immigrants from illegally crossing into Texas.

State officers and National Guard members also have denied Border Patrol agents entry to the park, where agents routinely used a boat ramp to launch their boats to patrol the Rio Grande, the filing says. There is also a staging area at the park that Border Patrol agents use to inspect migrants who have been apprehended in this part of the border, the filing says.

In the filing, the DOJ is asking the U.S. Supreme Court to intervene in an ongoing legal battle between the state and the federal government and overrule a 5th Circuit Court of Appeals ruling that prevents Border Patrol agents from cutting the concertina wire Texas has strung along the Rio Grande.

    Send in the FBI along with support of they’re using the Texas guard…

    Arrest everyone for interfering with federal law enforcement. If that doesn’t make the point, then we can get more extreme.

      Even simpler than that. Biden is the Commander in Chief. Abbot can mobilize the National Guard in his state, but at the end of the day if their commander receives a stand down order direct from the President, they MUST obey, or it’s insubordination and the penalty for insubordination within the military is much higher than in the private sector.

        Genuinely shocked more presidents haven’t whipped that one out against insubordinate governors, by now I’d have made a show of having them arrest Abbott on charges of human trafficking for the bus shit.

        That… assumes they listen. these fuckwits are already overstepping their legal authority. But yes, anyone in the Nat Guard should get a stand-down order and told to fuck off, and refusal… well FAFO applies.

        The problem is that Abbot is not just using Nat Guard, but also local cops. (and park rangers,). Those lot should get hit with federal obstruction charges.

              That’s sort of their shtick. They need the Republicans to exist so they are the only option for anyone capable of critical thinking. We have a right wing party and a religious, extremist party. I’m never going to vote for anyone who wants to make laws based on what their imaginary friend tells them, so I’m stuck voting for a bunch of corporate shills… Hooray.

        I’m saying they’re obstructing federal law enforcement. (BPC are federal LEOs,)

        the FBI is probably going to be better equipped to handle dealing with arresting a shit load of idiots who think that obstructing FEDERAL agents is a good idea, than the BPC. Arrest everyone and nail them with all appropriate charges.
